Govt Will Not Rob People of Their Land

Election after election and year in year out, the govt have been telling the people, particularly the Ibans, that NCR is no longer an issue. But is it true?

Why do we read almost every day that the Borneo Post is churning out news on the NCR? In fact it is th most single issue in Sarawak which will always attract the attention of any Sarawakian.

Returning back to the title. Is this true? Or are the bloggers mere nonsense people. Why would people spend hours day after day to update themselves on lies. Even if there are some errors in the news in the blog but no one can deny that there are substantial truth in the news which are being surpressed by the mainstream media.

In Sarawak, the govt made a fatal mistake in putting section 5(7) in the Land Code. Under this section, the claimant of a NCR land has to prove his claim. Where did the govt get this idea. In Australia, when the British colonised Australia, they came up with a concept called "terra nulis" meaning no man's land. The British regarded Australia as uninhabited land and therefore any one who needs land must get title from the govt.

Now is this true of Sarawak? The 3 successive Brooke Rajahs have repeatedly pronounced and recorded in the Dewan Undangan Negeri which is the oldest in Malaysia that Sarawak belongs to the natives. In his famous statement this is what the First Rajah said:

"Sarawak belongs to the Malays, Sea Dayaks, Land Dyaks, Kayans, Kenyahs, Milanos, Muruts, Kadayans, Bisayahs, and other tribes and not us. It is for them we labour, not for ourselves."

Even before the Rajah set foot in Sarawak [only Kuching Division at that time], Sarawak was already an inhabited country. There were many tribal nations. These tribal nations were independant nations. Wars were fought on territories. How then can the present govt say that the natives have to prove their claims before the govt can recognise their land rights. It should be the other way round. The govt must disprove the claims if the govt disputes the native claim. The burden to prove should be on the govt.

In the case of Rh Nyawin, what has happened? The court has yet to decide on the customary rights. But the govt is now saying that there is no rights. Is this not pre-empting the courts decision?

Inspite of the numerous denials by the govt, it is only aggravating the situation. In fact, if there is a little bit of humility on the part of the govt, many problems can be resolved. The govt must recognise the rights of the people before the problems can be resolved.

As long as the govt takes the higher ground and insists that the people follow them, they will find themsleves in the future being a govt of the rich and few but not the people. They may be in power for many years to come, but it comes with a heavy price where the people will live in misery and destitute.

Now is the time to make up for the loss. Repent and restore the lost rights of the people.

Dayaks Lacks Element of Smartness!!

Finally someone from the Dayak community now admits that the community lacks the element of smartness. Call this humility or sheer lack of caution of the repercussion on the maker is for time to tell. What is most astounding is that, this general statement would also refer to the one who said it out; not just the opposite side of the divide.

On one note it sounds very degrading to the Dayak community. But on the other hand, it reflects the general attitude of the community on itself. The community relealise that there is something missing within but could not identify what it is. We look around for scapegoat for the weakness and the backwardness of the community. In the end we play the accusing game. We accused all the others as not good except those who do the scolding.

This is why our leaders always breakloose. They tend to have the habit of scolding the community if there is something affecting the community. Leaders are like fathers. They should know better than the children. Being in the position, it is all up to them to bring up the family. Any failure should not fell squarely on the children.

Political leaders must learn to accept responsisbility towards the people. When the people are backward please do not berrate the poor folks who barely make ends meet. The leaders, after accumulating so much wealth from being in power must learn to appreciate the trust and support of the people.

Therefore, if there is no element of smartness in the Dayak community, it fell on the leaders. Any lacking in the community is due to the lacking of those in leadership. "We reap what we sow" is what the proverbs says.

RE: Burung Datuk Seri Anuar Ibrahim? [And Jabu’s “Analysis”]

In the true Iban custom, ‘death’ as ‘burung’ [sign from the god] during arrival of VIP (Pengabang) celebration, is interpreted as a manifest [sign] of the blessing by "Patara" accompanying the said VIP. In the offering (called piring in Iban custom) we normally drip it with blood of animal or bird. In the absence of blood, egg can be used as a substitute. In the case of Datuk Seri Anwar Ibrahim’s visit, the death of his own supporter may be regarded as the piring for his visit. Much respect must be given to the deceased for great sacrifice by dying for his beloved Leader. There were many instances and examples in the past, where deaths occurred during miring and begawai for welcoming VIP. The victims of VIP (pengabang) are normally children and elders of the longhouse. The victim would suddenly faint and or die when Patara Bungai Nuing and Keling were present. In this context the Iban elders would view any death during the visit as a sacrifice of "Patara" accompanying Datuk Seri Anwar Ibrahim’s visit. In Iban custom this is a very good omen- "burung ti bisa enggau cukup manah" [when there are accompanying signs means good omens] for Datuk Seri and the Longhouse. Datuk Patinggi Tan Sri Jabu knows what is burung manah. Anwar is exceptionally blessed by these good omens.

Jabu’s view that ‘mati’ [death] as a result of disrespect to our Iban custom is totally wrong and unacceptable. In this instant, there can be no salah burung [wrong omens] in death [“mati“] that took place. In the Iban custom, ‘salah burung’ happens when the seeker of guidance wrongly chose the sign given by the birds of omens. But in Dato Seri Anwar’s visit, it was not a question of wrong choice of omens. As such, there can be no Salah Burung!! There was no other kind of burung in that instant.

In the Iban custom, there are Jaik Burung [bad omens] or Manah Burung [good omens]. This usually applies when a man goes out for an adventure. In his process of going out he will be given guidance from omens or signs whether he will be successful or suffer misadventure. That is the case where jaik burung or manah burung applies. In other words, the Iban custom of burung does not bring curse but is only a guide to a person whether certain thing can be done or not.

In the Iban custom, ‘Tulah’ and ‘Burung’ are two different things. ‘Tulah’ is curse and is used only for disrespect for elders, or parent or parents-in-laws. ‘Tulah’ or curse does not and cannot apply in the case of Datuk Seri Anwar when paid his visit to the longhouse and his dear supporter died and neither does it a disrespect to the culture and customs of the Ibans. At best it is unavoidable and treated as an ordinary process of death. What more could we Iban possibly ask from Anwar? Is there any value more precious then the life of a friend sacrificed?

What then is it that made Jabu so angry? What is Jabu’s agenda when he equate that "Mati" is a disrespect to Iban custom or and culture? His interpretation that salah burung would only bring bad luck to the Visitor – Anwar is totally wrong. In burung custom the effect of "jaik and manah" would bring both visitor and the host good or bad omen. Why didn’t Jabu follow the true custom and inform the longhouse folks of the bad omen if any? Would the victim of the said curse have access to any remedy? If Jabu is a true Leader and knows the burung custom he must give the correct remedy. But his remedy of preventing the outsiders from going there is not only unacceptable but is also wrong in the Iban custom and practice. In this case, no remedy is required, as it is a good burung [good omen].

Why is Jabu was so angry with Anwar! He seemed to put the curse more important then any other incidents and happenings during his twenty over years as minister. We Iban could treat this Mati as nothing more then just another ordinary death. If the past experience may be taken as a guide, in the 1983 state election, one supporter, a local from Kampong Bungai was accidentally hit by election transport and a similar accident happened along the Bintulu -Tatau Road. Both of the candidates won the election.

We all know BN Leaders very well and supported them in the beginning but that vote of trust we gave them in the past have created a dictator. The government is now all for CM only. We think there is a line that has been drawn and this line of error is beyond tolerence. BN autocratic government has divided Malaysians two camps. Definitely BN and Jabu now felt challenged like never before. In the past the challenge was mainly from the DAP Chinese. Now Pakatan Rakyat [“PR”] lead by Anwar gives new and concrete hope of forming a new government. Bumiputras and Chinese realized that PR is serious a lot and much more concerned with transparency, integrity and ability. They are here to stay. The BN Government has lost it senses of responsibility and obligations to the rakyat. This is topped up with the tendency of BN leaders’ trends of lying to the Rakyat.

The state BN has disowned the native and native rights. They robbed the natives of their most precious property, namely, the right too occupy lands inherited from their ancestors. The natives from Merapok in Lawas to Tg Datu in Sematan have lost faith in BN government because of selective rules and very limited directions.

Jabu and BN failed to understand and see the importance of Pakatan Rakyat to Sarawakians. In the last general election, PR won West Malaysia because of Anwar factors. BN was only in power because Sabah /Sarawak voters. PR has also convincingly won the last two by-election in West Malaysia and will continue to win by- elections in West Malaysia with or without instant noodle project and instant contract. The Barisan National failures are because Malaysians do not trust BN and its leaders. A good example would be the current UMNO party election. The double standard in selective punishment: whereby Ali Rustam is punished but Khairy is only given a warning. With this double standard been practice, most UMNO Members felt betrayed and rightly so they raised the question on transparency, integrity and ability of BN to government our country

Jabu cannot deny that Sarawak and Sabah are far behind in development compared to West Malaysia. What changes can BN hope to give and what then is our hope of real development? Is it with the establishment of SCORE? What if BN lost in the next general selection? Will BN Sarawak and Jabu rejoice when SCOREs is finally owned by CMS?

The rakyat needs to change. BN cannot bring any changes and be transparent for the better. There are so many things that the government did in the name of development for the rakyat. Now is a Cyber age. We cannot hide these so call developments whether they are for the rakyat or the BN leaders and their selected families members. One clear example is where BN Sarawak failed to promote and develop small holding oil palm plantation among Sarawakians and particularly among the natives who have their NRC lands. Instead thousand of hectares are issued to his family and then sold to selected companies.

Jabu and BN leaders show their true colours and intention when native land owners are bypassed in the oil palm development.We have the worst scenario possible when landowners are sued and jailed for protecting and claiming their ancestral lands. While others are forced to sell their native customary rights lands at RM60 per hectare and some are threatened with legal actions. There are many cases in throughout Sarawak on land grabbing by the State government. Yet Jabu and BN YBs never voice their disapproval. Worst still James Masing even had the cheek to say in one of the Dewan Undangan Negeri sitting that there are no court cases involve native lands.

Welcome

Sape is the foremost and the principal musical instrument among the various Orang Ulu tribes of Borneo. Among the Orang Ulu tribes of Borneo there are many types of musical instruments but Sape leads them all.


As the leading musical instrument, it has been played in almost all occasions in feast and fiesta alike. The only occasion where it may not be played is mourning ceremony. A more sombre instrument like a flute may be played to soothe the solemn mood. Perhaps, as of now, a flute may be played to mourn for the loss, sufferings and the grieve of the Orang Ulu community except for the elite few in the elite circles.

But why the Sound of Sape?

Sound of Sape is chosen for the purpose of awakening and raising the alarm from our slumber of 45 years. It is sounded to remind our people that sometimes, long ago, we were happy people. We were freedom people. We were adventurous people. We were once the rulers of Borneo with our heads held up high in our own right. We were never oppressed. Whenever, inturders or invaders appear on the horizon on the boundary of our respective countries the war council are call. Once decision is made, the warriors are then sent our for war. Win or lose will determine the existence of the tribe concerned.

In the process many tribes became extinct while the conquerors displace the conquered. The victors then ensalve the vanquished.

Since the time of the Raja Brookes, war has taken a new dimension. Now, war has been transform into a new force altogether. But the aim is still the same- wealth and space. Now that the new war force is politics. Political parties are formed to replace to old war party.

Now in Borneo, the war parties have staked their grounds and boundaries. The war booties are the native customary rights lands, business deals, finance, rights and privileges and so on.

Caught in the midst of the war are the poor natives who just came out of the jungle and have to learn the tricks of the trade of life from nil and compete with the global community.

Suddenly, the natives of Sarawak realised that all these while they have been duped by the so-called trustees of their native rights and privileges. They are awakened now and have discovered that they have lost all their wealth and living space. They are treated as aliens in their own lands which their forefathers would not have surrendered easiliy.

God given opportunity is sweeping across the nation from the West to the East. It is over the horizone along the shores of Borneo. Can we Sarawakians place hope it that golden opportunity? YES WE CAN. WHO MAKE IT HAPPEN? WE MAKE IT HAPPEN. Not our leaders, because they are our very oppressors. Their war party is called Barisan Nasional [BN].

Our hope now is in Pakatan Rakyat which comprise of Parti Keadilan Rakyat [PKR], Democratic Action Party [DAP] and Parti Isalm Malaysis [PAS]. The wind is blowing fast. The rivers are flowing rapid. The storms are brewing. The fault line has been triggered under the sea for the tsunami. Get ready for the wind, rivers, storms and tsunami to come and storm Borneo.

String all the Sape. Get all the musicians ready. Get the maiden dancers with their gears on, their graceful hands beautified by the hornbill feathers. Get the warriors dancing gear on.

The moment victory strikes the leading Sape player must strum his first beat. The dancers must stretch they hands to begin the new order of government.

The Sound of Sape give Hope to the Orang Ulu community. It can never go wrong because the sound is the manifestation of joy and peace in the land.

WHERE THERE IS NO WAY, GOD WILL MAKE A WAY. WHERE THERE IS NO HOPE, GOD WILL GIVE US HOPE.
